Important details

  • Corruptly paying a witness to influence testimony, or to get the witness to stay away, is witness bribery (18 U.S.C. §201(b)(3), (4)) and falls under the perjury guideline (§2J1.3) instead.
  • The general obstruction adjustment (§3C1.1) is not added on top, unless the person also obstructed the witness payment case itself (§2J1.9, note 1).
  • If the person is also convicted of the crime the payment related to, special grouping rules apply (§2J1.9, note 2).
