What changes the sentence

Important details
- If someone died, the murder guidelines apply instead if they give a higher level: first-degree murder if the death was caused intentionally or knowingly, otherwise second-degree murder (§2M5.3(c)(1)).
- If the offense amounted to attempted murder, the attempted murder guideline applies if it gives a higher level (§2M5.3(c)(2)).
- If the support included a nuclear weapon, nuclear material or nuclear byproduct material; a chemical weapon; a biological agent, toxin or delivery system; or another weapon of mass destruction, §2M6.1 applies if it gives a higher level (§2M5.3(c)(3)).
- A separate terrorism adjustment (§3A1.4) often applies in these cases and raises the sentence sharply.
