“No criminal history points, early plea” assumes zero criminal history points, no weapon, no violence and no leadership role, so the plea reduction and the 2-level zero-point reduction both apply. The mandatory minimum column assumes no prior serious drug felony or serious violent felony; the safety valve can remove it. For ice, it also assumes the amount shown is pure methamphetamine: the statute counts only the pure drug the ice contains.
What to know
- Because the statutory minimums count the pure drug, ice at 80% purity reaches them at a higher gross weight: 50 grams of ice may hold only 40 grams of pure methamphetamine, which carries the 5-year minimum, not 10. The guideline level uses the full weight of the ice; the calculator flags the amounts where the minimum depends on the lab's purity result.
Frequently asked questions
What amount of pure methamphetamine or “ice” triggers a federal mandatory minimum?
5 g of pure methamphetamine triggers a 5-year mandatory minimum, and 50 g triggers 10 years (21 U.S.C. §841(b)(1)), for someone without a prior serious drug felony or serious violent felony. For ice, those amounts are the pure methamphetamine it contains, so ice under 100% purity needs more gross weight: 5 g of 80% ice holds only 4 g.
What is the guideline sentence for 100 g of pure methamphetamine or “ice”?
The Drug Quantity Table puts 100 g at level 30. For someone with no criminal history points who pleads guilty, with no weapon, violence or leadership role, the guideline sentence is 120 months, driven by the 10-year minimum. With the safety valve it is 46–57 months.
Does the weight include the packaging or cutting agents?
Packaging, no. Cutting agents, yes: the weight is the entire mixture or substance containing a detectable amount of the drug, except for drugs the table measures by purity.
